CONDITIONS OF ACCESS AND USE

The present General Conditions, together with the other Terms and Conditions, form the legal framework regulating the use of the website www.sportsemotions.com, owned by Sportsemotions, S.L. (hereinafter referred to as Sportsemotions), as well as the services provided by Sportsemotions by means of the same. These are always available in various languages at www.sportsemotions.com to view, download or print out.

The necessary information about the procedures to be followed by the users to in order to purchase the various packages or ticket packages (tickets with additional services for various events), the Terms and Conditions, refund policy, privacy policy etc. provided by Sportsemotions can be found in this Section.

1. Applicable law and jurisdiction:

These General Conditions, together with any other particular conditions that may be established, expressly regulate the relationships between Sportsemotions and third parties (hereinafter referred to as “Users”) who contract through the portal www.sportsemotions.com

The present General Conditions have been drawn up in accordance with the provisions of the Spanish Act 34/2002 on Information Society and Electronic Commerce Services, the Spanish Act 7/1998 on General Contractual Conditions, the Spanish Royal Decree 1906/1999 which regulates telephone or electronic contracting with general conditions regulated in Article 5.3 of the Spanish Act 7/1998, the Spanish General Act 26/1984 for the Protection of Consumers and Users, the Spanish Act 7/1996 on Retail Commerce, and any other legal dispositions that may be applicable.

Jurisdiction: These General Conditions are subject to Spanish legislation. Any dispute arising in connection with the validity, interpretation and/or application shall be subject to the Spanish Courts with jurisdictional competence in this matter.

2. Acceptance of Legal Disclaimer:

From the moment when the users/customers make a reservation, it is presumed that they have read and accepted the established contract terms and conditions.

All purchases and reservations made through the www.sportsemotions.com website are governed by these Contract Terms and Conditions.

3. Objective of the Contract:

The objective of the contract between the users and the owner of the website is the purchase of packages, or a ticket package, for events held both in Spain and abroad. The price paid by the client includes additional services and values.

4. Acceptance of Website by Users:

The user obliges to use the services and content on our website in accordance with the legislations and the General Conditions and Terms of the services provided by Sportsemotions at all times, abstaining from using them for the following purposes:

• To introduce programs into the network capable of causing damage to the computer systems of Sportsemotions, their suppliers or third-party users of the internal network, or of this website.
• To perform illegal, fraudulent and/or unsocial activities that prevents a correct functioning of the webpage, as well as its network or resources.
• To reproduce, copy, sell or commercially exploit any of the content available on the website.

• To make any fraudulent transactions. Any indications of fraud will be reported to the authorities.

5. Intellectual Property:

All content provided by Sportsemotions, as well as the content available on the network through their web pages, constitute an entire work in accordance with the meanings of the regulations on intellectual property, and are thereby protected by the relevant international laws and conventions applicable in this sector.

Any form of reproduction, distribution, public disclosure, transformation, provision, and in general any public exploitation of both the webpages, their content and information, is prohibited without the express and previous consent of Sportsemotions.

The information provided on the website may be used for private purposes, but the express consent of Sportsemotions is required to distribute the information obtained.

6. Price Policy Information:

The prices of the ticket packages offered on the website include VAT. There is a difference in the nominal value of the tickets due to the services offered and provided by Sportsemotions.

The difference between the nominal value of the ticket and the value of the ticket package due to the additional services acquired has been understood and accepted by the client/user when making a purchase or reservation.

7. Regulations on Cancellations and Right of Withdrawal: The user shall have the right of withdrawal from the purchase made in accordance with Article 44 of the Spanish Act 7/1996 of 15 January regulating Retail Trade, reformed by the Spanish Act 47/2002 of 19 December.

8. Links and Trademarks:

TheSportsemotions internet page may contain links to third-party webpages. Therefore, they cannot assume any responsibility for content that appears on third-party webpages. All texts, images, sounds, animations, software, and other content contained in this website are the exclusive property of Sportsemotions, or their licensors. Any act of transmission, distribution, sale, reproduction, storage or public communication, whether total or partial, must have the express consent of Sportsemotions.

9. Personal Access Code: The user may create a personal access code to enter the restricted areas. The user shall be responsible for all activities carried out with the use of the selected code.

10. Event Types

Events are classified according to their different characteristics, whereby each type has a different tab.

• Tickets at face value price
• Tickets with 20% commission charges
• Tickets on special offer
• Tickets in a Tourist Package These may include various joint or individual services
• Tickets with a double package 2x1 (ticket for the event + ticket for another place)

For events with a "Ticket Swop" or "Ticket Exchange" tab, Sportsemotions does not act as direct provider or official agency, but only allows users to purchase tickets or packages from other vendors. In this case, the various vendors set their own prices, which can increase depending on the commission fees charged.

11. Events: Schedules, change of dates and refunds:

Both the sports and musical events offered on the www.sportsemotions.com website may suffer changes in time schedules and dates for reasons beyond the control of Sportsemotions. The organisers are responsible for these changes so that any changes, whether in date or time, do not entitle a ticket refund for those clients who purchased a ticket package, nor will the amount paid be refunded by Sportsemotions.

We recommend that all users check the dates and times of the matches. Due to the obligations of European competitions and TV broadcasting, matches originally scheduled for a specific date may be modified to another date.

Once you arrive at the city where the event is to take place, we recommend that you verify the information on the match in the local press, or at the hotel reception and regularly consult our website too.

The user is responsible for knowing the exact date and time of the event. The users purchase a ticket package for a specific event, but not necessarily for a specific date.

Sportsemotions will announce any modifications in the various events offered on their web page. If the event is cancelled definitely due to force majeure, adverse weather conditions, strikes, etc. Sportsemotions will refund their customers the full amount paid, unless the show or event is rescheduled, since in this case the service purchased is valid for the new date.

Other refunds corresponding to travelling and hotel costs depend on the % of cancellation fees applied by the hotels and travel agencies.

12. Delivery Policy:

All ticket packages purchased through the website will be delivered to the users in the following manner:

• By courier service
• By Sportsemotions staff
• In those areas designated by Sportsemotions for their clients

Deliveries are made up to the same day of the event purchased, but in order to perform this service the user must provide Sportsemotions with a valid delivery address in the same city where the event is being held. If there is nobody at the address provided by the purchaser to receive the delivery, any delay in delivery is attributed to the purchaser, and not to Sportsemotions. If the client does not provide a delivery address at least 7 days before the celebration of the event, Sportsemotions may cancel the purchase with the corresponding costs incurred.

Sportsemotions cannot be held responsible for any mistakes made by the clients when providing delivery details.

Box Office Collection: Sportsemotions provides the option to collect the tickets in the Club box office, as long as this option is acknowledged to Sportsemotions by the club. In this case, Sportsemotions will send the necessary information to collect the purchased tickets by email to the purchaser. Sportsemotions may not be held responsible if the purchaser does not follow the instructions provided by the company when collecting the tickets, nor in those cases where the client does not collect them.

Sending Ticket Packages to:

• Private addresses: When a client buys tickets for an event and instructs us to deliver it to a private address or company, Sportsemotions understands that this address is of utmost confidence, allowing www.sportsemotions.com to deliver the tickets to any person living at the address provided by the client.
• Hotels: When a client buys tickets for an event and instructs us to deliver it to a hotel reception, Sportsemotions understands that this address is of utmost confidence, authorising www.sportsemotions.com to deliver the envelope to the hotel reception at the address indicated by the client.
• www.sportsemotions.com will request the signature or seal of the establishment from the hotel reception, or apartment, as proof that delivery has been made properly, whereby this document is considered irrefutable proof that the service has been performed as requested by the client.

13. Liabilities of Sportsemotions for deliveries:

Sportsemotions only acts as an agent for the client and shall have no liability in any agreements made with third parties.

Sportsemotions cannot be held liable for any non-compliance of delivery by those contracted to perform the delivery. Nor shall they be liable for the loss or theft of these items while they are in the hotel reception of the hotels, motels or apartments waiting to be collected by the client.

14. Product Liability

All Ticket Packages are sold subject to availability.

If the user purchases two or more tickets for the same event, Sportsemotions is not obliged to deliver tickets for adjacent seating, since this depends on the availability of the event. However, they will do their utmost to provide the purchaser with two tickets for seating as close as possible, although they may be far apart. , for any reason, Sportsemotions cannot provide the client with the tickets of the same category purchased, they will offer the client two options:

a)A higher-category ticket for the same price, or

b)A lower-category ticket, refunding the client the difference in price.

If, for any reason, it were impossible to provide the user with the tickets specified in the package purchased, or to offer any other solution, Sportsemotions is obliged to refund 100% of the amount paid by the client.

15. Limitation of Liability

The maximum liability assumed by Sportsemotions for the provision of the service is the amount of the ticket package plus 5%, limitation that the user accepts when purchasing from Sportsemotions.

Sportsemotions may never be held liable for any loss of profits resulting from an error in a commercial operation.

16. Payment methods

All payments are made on the Sportsemotions webpage with a Visa or MasterCard credit card.

The payment system is provided by the bank (BBVA), so the payment process is implemented by them and Sportsemotions has no access to the card details.

The confidentiality of your data, which will not be used for any purpose other than to manage the sales and reservations made, is thus guaranteed.

A maximum security automatic encryption system is used by means of the Secure Server Layer (SSL) protocol with an encryption key length of 128 bits where all data is securely transmitted through the SSL system (Secure Sockets Layer).

Any other payment methods will be informed on the Sportsemotions website.

17. Refunds

All users have the right of withdrawal from the purchase in accordance with Article 44 of the Spanish Act 7/1996 of 15 January regulating Retail Trade, and reformed by the Spanish Act 47/2002 of 19 December.

18. Obligations

If Sportsemotions has evidence to suggest that any users are performing fraudulent transactions, it will be reported immediately to the competent authorities. The users undertake not to make any fraudulent transactions.

Sportsemotions will take all possible measures to ensure the correct functioning of the webpage, and will do their utmost o solve any technical problems or force majeure that prevent access to the website, but Sportsemotions may not be held liable for these problems.

19. Regulations on Champions League and UEFA Cup fixtures

With regard to the acquisition of tickets for the UEFA Champions League or Europa League, and in implementation of the UEFA regulations, only tickets for areas where the local public is located may be acquired. Maximum efforts are made to segregate the fans as established in the UEFA regulations and the Spanish Sport Acts 10/1990 and 19/2007.
